MindFlow Terms of Use

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the MindFlow mobile application (“the app”) provided by Deepak Kumar / KAD Labs (“we”, “us”, or “our”).

By downloading, installing, accessing, or using MindFlow, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the app.

2. License Grant & Permitted Use

Subject to your compliance with these Terms, KAD Labs grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use MindFlow on your personal Android device solely for your own personal, non-commercial entertainment and wellness purposes.

You agree not to:

• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the application.
• Extract, rip, record, redistribute, broadcast, commercially exploit, or publicly perform the audio tracks, soundscapes, sleep stories, narration, or graphic assets contained in the app.
• Bypass, disable, or tamper with digital rights management, content gating, paywalls, or subscription entitlement checks.

3. Subscriptions, Free Trials, and In-App Purchases

MindFlow offers both a free limited tier and optional premium subscription tiers (such as Yearly with 3-Day Free Trial, Monthly, and Lifetime Access).

• 3-Day Free Trial: Free trial eligibility is determined by Google Play. If you sign up for a subscription offering an introductory 3-day free trial, your subscription will automatically convert into a paid annual subscription at the end of the 3-day trial period unless you cancel in your store account settings before the trial ends.
• Auto-Renewal: Paid subscriptions automatically renew for the same duration (e.g., annually or monthly) unless cancelled through your Google Play Store account settings at least 24 hours before the end of the current billing cycle.
• Cancellation & Refunds: You can manage or cancel your subscription at any time by navigating to Google Play Store > Profile Icon > Payments & Subscriptions > Subscriptions. Cancellation takes effect at the end of your current paid billing period. Refund requests are subject to Google Play refund policies.
• Lifetime Access: Lifetime access grants you permanent access to MindFlow's premium sound library and features for the operational life of the app without recurring subscription charges.

4. Intellectual Property Rights

All rights, title, and interest in and to MindFlow—including but not limited to the software, user interface design, visual styling, brand names, logos, original rain and ambient acoustic masters, soundscapes, multi-track audio compositions, bedtime sleep stories, guided meditation narration, and written text—are owned exclusively by Deepak Kumar / KAD Labs. All rights not expressly granted herein are reserved.

5. Wellness & Health Disclaimer

MindFlow is intended solely as an ambient acoustic aid for general relaxation, concentration, and sleep hygiene.

• MindFlow does not provide medical, psychological, psychiatric, or healthcare advice.
• Never use headphones or listen to sleep/relaxation audio while driving a motor vehicle, operating heavy machinery, or engaging in tasks requiring full situational awareness.

6. Disclaimer of Warranties

MindFlow is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will operate error-free, uninterrupted, or compatible with every device configuration.

7. Limitation of Liability

To the fullest extent permitted by applicable law, KAD Labs and Deepak Kumar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your access to or use of (or inability to access or use) MindFlow.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make updates, we will update the “Last Updated” date at the top of this document. Your continued use of MindFlow following any modifications indicates your acceptance of the updated Terms.
